This policy applies to our website at herdsmangroup.online and to the general business and investment group services we provide.
2. Personal information we collect
We only collect personal information where it is reasonably necessary for one or more of our functions or activities. The kinds of personal information we may collect include:

We do not collect sensitive information (such as health information or information about racial or ethnic origin) unless it is reasonably necessary for our functions or activities and you have consented, or the collection is otherwise permitted under the APPs.
3. How we collect personal information
We generally collect personal information directly from you, for example when you complete the contact form or quote form on this website, or when you correspond with us by email. We may also collect information from public sources, such as the ASIC business registers, where it is relevant to the services we provide to you. Some technical information is collected automatically through cookies and analytics tools as described in section 9.
Where it is lawful and practicable, you may deal with us anonymously or using a pseudonym. However, this may not be practicable where we are required or authorised by law to identify you, or where we cannot provide our services without your details.
4. Purposes of collection, use and disclosure
We collect, hold, use and disclose personal information for purposes including:
- responding to your enquiries and preparing quotes for prospective clients;

We will not use or disclose personal information for a secondary purpose unless you would reasonably expect us to do so, you have consented, or the use or disclosure is otherwise permitted or required under the APPs or other Australian law.
5. Direct marketing
We may use your contact details to send you information about our services where you have consented or where you would reasonably expect this. Every marketing communication will include a simple way to opt out, and you may also ask us at any time to stop by emailing ceo@herdsmangroup.online. We will action opt-out requests promptly and free of charge.
6. Disclosure of personal information
We do not sell, rent or trade personal information. We may disclose personal information to:
- professional advisers, such as accountants, auditors and lawyers, who are bound by duties of confidentiality;
- service providers who assist us with website hosting, email delivery, analytics or payment processing, under contractual arrangements that protect your information;
- government agencies, regulators and courts where disclosure is required or authorised by law; and
- other parties where you have given your consent.
7. Overseas disclosure
Some of our service providers may store or process personal information outside Australia. Where personal information is likely to be disclosed to an overseas recipient, we take reasonable steps, in accordance with APP 8, to ensure the recipient does not breach the APPs in relation to that information, or to otherwise satisfy our obligations under the Privacy Act.
8. Data quality and security
We take reasonable steps to ensure that the personal information we collect is accurate, complete and up to date, and to protect it from misuse, interference, loss and from unauthorised access, modification or disclosure. Access to personal information is limited to personnel and service providers who need it to perform their duties.
We retain personal information only for as long as it is reasonably necessary for the purposes set out in this policy, or as required by law (for example, record-keeping obligations that apply to business and financial records). When information is no longer required, we take reasonable steps to destroy it or ensure it is de-identified.
9. Cookies and website analytics
This website uses cookies and similar technologies to support its functionality, remember your preferences and understand how visitors use the site. Most browsers allow you to refuse cookies or delete them through your browser settings. If you disable cookies, some parts of this website may not function as intended. Analytics information is used in aggregate form and is not used to identify individual visitors.
10. Access and correction
You may request access to the personal information we hold about you, and ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, email ceo@herdsmangroup.online. We will respond within a reasonable period after your request is made. In limited circumstances, we may decline a request where permitted under APP 12 or APP 13, and if so we will provide written reasons and information about how to complain.
11. Notifiable data breaches
If we experience an eligible data breach that is likely to result in serious harm to any individual whose personal information is involved, we will notify those individuals and the Office of the Australian Information Commissioner (OAIC) as required by the notifiable data breaches scheme in Part IIIC of the Privacy Act, and we will take prompt steps to contain and remediate the breach.
12. Complaints and enquiries
